1. Scope
The terms and conditions apply to all orders placed via our online shop.
The terms and conditions apply to companies for future business relations without the need for a formal expression. Unless expressly approved by us, we cannot accept the contractual validity of any conflicting or additional general terms and conditions used by a company.
2. Vouchers
Nut Paradise vouchers can be used with any product purchased at https://notenparadijs.com. Our general terms and conditions, together with the terms and conditions below, apply to shopping with the gift voucher.How do I receive vouchers?You will receive the vouchers packed in the "Art Edition" by post to your home. There you will find an individual code on the voucher, which you can then enter online at the end of your next order. The respective amount will be deducted from your order at the time of purchase.How can I redeem the voucher?
Vouchers can be used to purchase any product at https://notenparadijs.com. Select the item(s) you wish to order and add it to your shopping cart. To use your voucher, enter the individual code on your voucher in the "Enter coupon code" box in your shopping cart and then click on the black arrow. The value of your voucher will now be applied to your order and debited from your shopping cart.
How many vouchers can I redeem at once?
You can use multiple gift vouchers per order. No remainder will be issued if the full value of the voucher has not been used in an order. The remainder remains with you as a voucher, which you can use for your next order. You can also use your gift voucher in combination with other discount codes.
The voucher can only be used for the purchase of goods and not for the purchase of additional vouchers.
Who can redeem a voucher?
Anyone who offers a discount voucher can redeem it. The voucher is a so-called small paper to bearer in accordance with § 807 BGB, which entitles someone who claims it to his claim. Even if a voucher is issued for a specific person, the exhibitor can afford it to another person who submits the voucher to him.
How long is my voucher valid?
Your voucher is valid for three years. The three years from the end of the year in which the voucher was issued are calculated (§§ 195, 199 BGB)
I have used a voucher to pay for an order. What happens if I want to return my order?
For orders that are refunded, the refund will be made using the same payment method as when paying for the order. Therefore, if you have paid or paid for part of an order with a Noten Paradijs gift voucher, any refund will be refunded in gift vouchers of the same value.
Can I return my voucher?
Vouchers in physical form can be returned or refunded like any other embodied article. The general statutory right of withdrawal applies with a withdrawal period of 14 days. The condition is that the voucher has never been used. With the use of the voucher, the right of withdrawal expires immediately.
3. Contractual partners, contract formation
The purchase contract is concluded exclusively with Noten Paradijs.
The display of products in the online shop constitutes a binding offer on our part to conclude a contract with the articles. You can place our products in the shopping cart without obligation and remove them again before submitting a binding order. The contract is formed by clicking on the order button, with which you indicate that you accept our offer with regard to the goods in the shopping cart. As soon as the order has been sent, you will immediately receive a confirmation by e-mail.
4. Contract language, saving the contract text
The languages available for the contract are German and English.
We save the text of the contract and send the data and our conditions by e-mail. The text of the contract is not accessible via the Internet for security reasons.
5. Terms of delivery
Shipping costs are added to the price of the products. Shipping costs are explained per product.
We ship our goods, collection of products by consumers is not possible.
6. Payment
The following payment methods are available:
Prepayment
If you choose this method, we will provide you with our bank details in an e-mail and deliver the goods after receipt of the money.
PayPal
During the ordering process you will be redirected to the PayPal website. In order to pay with PayPal, you must be registered. Enter your details and confirm the payment instructions to us. After your order has been submitted, we instruct PayPal to initiate the payment. The payment is then processed directly by PayPal. You will receive additional information later during the ordering process.
SOFORT Banking
After placing the order, you will be redirected to the SOFORT website. To pay via SOFORT, you must have an online banking account with PIN/TAN. You will receive additional information later during the ordering process. The payment transaction is carried out by SOFORT and then debited directly from your bank account.
Amazon Pay
During the ordering process, you will be redirected to the Amazon website. In order to pay, you must be registered with Amazon and identify yourself first. There you must confirm the delivery address and payment method. You will then be redirected back to our webshop where you complete the ordering process. Immediately after the order, we instruct Amazon to initiate the payment. The payment is processed automatically. You will receive additional information later during the ordering process.
7. Retention of title
The goods remain our property until payment has been made in full. For companies, the following also applies: We retain ownership of the goods until all claims arising from an ongoing business relationship have been fully settled. You may resell reserved goods in the normal course of business; you may collect all claims arising for this purpose, regardless of the connection or mixing of the reserved goods with a new item, in the amount of the invoice amount in advance to us and we accept this assignment. You remain entitled to collect the claims; we can actually collect the claims ourselves, if you do not meet your payment obligations.
8. Damage during delivery
For consumers, the following applies:
If the goods are delivered with obvious damage caused during delivery, report this to the courier and also inform us of this immediately. Failure to file a complaint or to make contact does not affect your statutory rights or the enforcement of such rights, in particular your warranty rights. However, by doing so, you help us to assert our own claims against the carrier or transport insurer. .
For companies, the following applies:
The risk of accidental loss or deterioration of the goods passes to the consumer as soon as we have submitted the item to the carrier or other contractor for shipment to the defined person or establishment. "Kaufleut" as defined by the German Commercial Code are subject to the inspection and notification requirements set out in § 377 HGB: The buyer must examine the goods immediately after delivery by the seller, as far as this is practically possible. If a defect is discovered, this must be notified to the seller immediately. Should one not adhere to the instructions described therein; the goods are deemed to have been approved unless the defect could not have been discovered during inspection. This does not apply if a specific defect has been fraudulently concealed by us.
9. Warranty
We have a legal obligation to deliver products that are in accordance with this contract. For consumers, statutory warranty rights apply, which are subject to the law of the country in which the consumer has his habitual residence. 10. Liability
In any event, we are liable without limitation for claims for damages caused by us, our legal representatives or legal agents.

11. Online dispute resolution

In order to settle disputes arising from a contractual relationship with a consumer or to see whether such a contractual relationship already exists, we will participate in dispute resolution proceedings before a consumer dispute resolution body. 12. Final provisions If you are a company, Dutch law applies, excluding the UN Sales Convention. If you are a “Kaufmann” within the meaning of the Dutchland Handelsweg (HGB), a legal entity under public law or a special fund under public law, the exclusive legal jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
